Shadowy Exports: Nine Indicted for Illegally Shipping AI Servers to China

In a significant legal development, nine individuals—including employees from NVIDIA and Super Micro—have been indicted in Taiwan for allegedly orchestrating the illegal export of advanced AI servers to China. This revelation underscores persistent concerns about breaches of export controls despite stringent regulations in place.
According to prosecutors in Keelung, these individuals formed a collusive network that prioritized profit over legality, leading to the illicit transfer of high-capacity servers. In their statement, officials cited not only the increase in compliance costs for corporations involved but also the severe damage inflicted on Taiwan’s international standing.
NVIDIA, while an American enterprise, has deep ties to Taiwan through manufacturing operations, notably with the Taiwan Semiconductor Manufacturing Company (TSMC), the world’s foremost chip producer. While some of NVIDIA’s latest chips are crafted in Arizona, they frequently undergo advanced packaging in Taiwan, creating complexities in export regulation compliance.
Since 2022, the U.S. has placed a ban on cutting-edge AI technology sales to China. Although the U.S. has recently modified its stance to permit older products, Taiwan remains particularly vigilant against exporting newer technologies, fearing repercussions from U.S. authorities.
Despite these restrictions, illegal channels have emerged. In a troubling instance, allegations surfaced that around $1 billion worth of NVIDIA server racks were transshipped through Southeast Asian countries like Thailand and Malaysia, circumventing established export controls. Additionally, cases have arisen where individuals faced charges for smuggling billions of dollars’ worth of AI servers to China under the radar.
This latest indictment not only highlights the complexities of global tech trade but also serves as a reminder of the ongoing battle against illicit export practices that threaten national integrity.
